What is LMPC registration ?

As toys are intended for children under the age of 14, it is important that they do not pose a risk to children’s health and safety. To protect the interests and welfare of children, the Quality Control Rules, 2020, issued by the Government of India, from January 1, 2021, will require toy manufacturers and importers who wish to sell toys in India to: It states that BIS certification of toys will be mandatory. BIS certification ensures that the toys meet the safety and quality standards set by the Indian government.

The Legal Metrology Act, 2009 regulates the import, sale and distribution of packaged goods in India. Prepackaged products are packed without a buyer when the quantity of the product is predetermined. Registering products under this law increases consumer awareness and reduces unfair trade practices.

LMPC registration is mandatory for importing pre-packaged goods. As per the Legal Metrology Packed Products Regulations, 2011, all importers and packers of packaged products are required to register under Regulation 27 of the Legal Metrology Act, 2009. Applicants must submit their application within 90 days of commencing import operations.

To obtain an LMPC license, products must be of the correct dimensions and handled authentically and accurately. LMPC certificates are not required for packers importing goods weighing less than 10 grams per milliliter or agricultural products weighing more than 50 kilograms.

Importance of LMPC registration

According to Regulation 27 of the Legal Metrology Regulations for Packaged Products, an LMPC import permit must be obtained before importing packaged goods for sale or distribution within the country.

According to the Ministry of Consumer Affairs, an importer or manufacturer who sells prepackaged products in a state must apply to the Legal Metrology Administrator for that particular state.

Importers selling in multiple states must register with the Center Director. The same rules apply to local manufacturers who sell products in multiple states.

  • Pan Card of the authorized person
  • Aadhar Card of the authorized person
  • Rent Agreement or lease deed or ownership deed of the factory or office premises
  • Contact no. and email id of the manufacturer

Expected LMPC certification delivery time period

30 days from the date of submission of the application.

Marking and Labelling Guidelines of LMPC registration

All prepackaged goods must be declared by the importer/manufacturer with the following information:

  • Name and address of importer and manufacturer. 
  • General description of package contents. 
  • Origin of import.
  • A quantity measured or weighed in standard units. 
  • Import and manufacturing data. 
  • MRP (Maximum Retail Price). 
  • Product dimensions and sizes. 
  • Contact details of the person or organization responsible for handling the complaint.

Whether it’s in Hindi or English, packages require a certain structure.

Penalties for violations of the LMPC Rules

Licensees must comply with the rules and regulations established by the Bureau of Legal Metrology. If the legal requirements for measuring packaged products are violated, the importer will have to pay a late fee if he applies for the LMPC certificate more than 90 days after the start of the import.

Validity of the LMPC registration

LMPC certificates are valid for a minimum of one year, i.e. 12 months, and a maximum of five years, i.e. 60 months.

Exemptions from LMPC certification for companies

  • For packaged products weighing less than 10 grams or 10 milliliters. 
  • The packaging weight of agricultural products exceeds 50 kg. 
  • Fast food packaged and prepared in restaurants and hotels. 
  • Chemical preparations covered by the Medicines (Price Control) Order 1995. 
  • Packages larger than 25 kilograms or 25 liters are prohibited, with the exception of cement and fertilizer packages, which usually weigh around 50 kilograms. 
  • Public package for industry or institutions.
